    Terms of Service

    These Terms of Service ("Terms") govern your access to and use of Trepeat (the "Service"), operated by Trepeat, a Malta sole trader ("we", "us", "our"). By creating an account or using the Service at trepeat.com or app.trepeat.com, you agree to be bound by these Terms.

    1. Acceptance of Terms

    By accessing or using the Service, you confirm that you are at least 18 years old, have the legal capacity to enter into a binding contract, and accept these Terms in full. If you do not agree, you must not use the Service.

    2. Description of Service

    Trepeat is a software-as-a-service tool that repeats trades from a designated source account to one or more follower accounts connected through MetaTrader 4 or MetaTrader 5 brokers. We are not a broker, introducing broker, futures commission merchant, commodity trading advisor, or financial adviser. We do not provide trading signals, recommendations, or investment advice.

    3. Acceptable Use

    You agree not to:

    • Use the Service for any unlawful purpose, including market manipulation, money laundering, or violation of broker terms of service.
    • Attempt to reverse-engineer, decompile, or extract the source code of the Service.
    • Probe, scan, or test the vulnerability of any system or network without prior written authorisation (see our Security policy at /security).
    • Resell, sublicense, or otherwise commercially redistribute the Service without our prior written consent.
    • Share your account credentials with any third party.
    • Use the Service to violate the terms of any prop-firm, broker, or exchange agreement to which you are a party.

    The list above is a summary. Our full Acceptable Use Policy is the canonical statement of prohibited conduct and forms part of these Terms.

    4. Account Registration and Security

    You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us immediately at support@trepeat.com of any suspected unauthorised access. We are not liable for any loss arising from your failure to safeguard your credentials.

    5. Subscription, Trial & Payment

    New users receive a 14-day free trial on signup. A valid payment method is required to start the trial; you will not be charged until the trial ends, and you may cancel at any time before then to avoid any charge. After the trial, continued access requires a paid subscription. Payments are processed by Stripe (Stripe Payments Europe, Ltd. for customers in the EU) through Stripe Checkout and Stripe Billing. Stripe Tax calculates and collects any applicable VAT, GST, or sales tax based on your billing location.

    Subscriptions renew automatically at the start of each billing cycle (monthly or annual, as selected). You may cancel at any time from within the application or via the Stripe Customer Portal; cancellation takes effect at the end of the current paid period. Refunds are governed by our Refund Policy, which forms part of these Terms.

    6. Right of Withdrawal (EU Consumers)

    If you are a consumer in the European Union, you normally have the right to withdraw from a distance contract within 14 days without giving a reason, under the Consumer Rights Directive (2011/83/EU). The Service is digital content / a digital service supplied immediately on subscription.

    By starting your paid subscription (including by converting from the free trial or otherwise beginning to use the paid Service within the 14-day period), you expressly request that we begin supplying the Service immediately and you acknowledge that you thereby lose your 14-day right of withdrawal once supply has begun, as permitted by Article 16(m) of the Directive. If you do not wish to waive this right, do not start the paid Service within the withdrawal period. This does not affect any separate refund we choose to offer under our Refund Policy.

    7. Trading Risk Disclaimer

    Trading involves substantial risk of loss and is not suitable for every investor. The Service simply repeats trade actions you take on your source account; it does not generate, recommend, or evaluate trades. Past performance is not indicative of future results. Leverage can magnify both gains and losses. You alone are responsible for every trade executed in your accounts.

    8. No Liability for Copy-Execution Failures or Broker / Third-Party Outages

    The Service depends on third-party infrastructure including, without limitation, MetaTrader brokers, MetaAPI, Supabase, Amazon Web Services, Cloudflare, and Stripe. We are not responsible for downtime, latency, order rejections, slippage, requotes, partial fills, or other failures attributable to these third parties or to your broker. Trade copying is provided on an as-is, best-efforts basis: we do not warrant that copy execution will be uninterrupted or error-free, and we disclaim responsibility for missed copies, delayed or duplicate orders, failures to open or close follower positions, and any trading losses arising from engine, broker, or third-party (including MetaAPI) outages or degradation. We do not guarantee that every trade on a source account will be repeated to every follower account; you are responsible for monitoring your accounts and reconciling positions.

    9. Limitation of Liability

    To the maximum extent permitted by law, Trepeat shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation lost profits, lost trading opportunities, or losses resulting from missed, duplicated, delayed, or mistimed trade copies, failures to open or close follower positions, or engine, broker, or third-party (including MetaAPI) outages. Our total aggregate liability arising out of or in connection with these Terms shall not exceed the total amount you paid us in the twelve (12) months preceding the event giving rise to the claim.

    10. Intellectual Property

    The Service, including all software, design, graphics, branding, and documentation, is the exclusive property of Trepeat and its licensors, and is protected by copyright, trademark, and other applicable laws. We grant you a limited, non-exclusive, non-transferable, revocable licence to access and use the Service for your internal use, subject to these Terms. No other rights are granted by implication or otherwise.

    11. Termination

    You may terminate your account at any time from within the application. We may suspend or terminate your access immediately, without notice, if we reasonably believe you have breached these Terms, used the Service unlawfully, or created a security or reputational risk to the Service or its users. Upon termination, your right to use the Service ceases immediately and we may delete your data in accordance with our Privacy Policy.

    12. Changes to These Terms

    We may update these Terms from time to time. When we make a material change we will revise the "Last updated" date above and notify registered users by email before the change takes effect. Continued use of Trepeat after the effective date constitutes acceptance of the revised Terms.

    13. Governing Law

    These Terms are governed by and construed in accordance with the laws of Malta, without regard to its conflict-of-law principles. The United Nations Convention on Contracts for the International Sale of Goods does not apply.

    14. Dispute Resolution

    Any dispute, controversy, or claim arising out of or relating to these Terms shall first be addressed by good-faith negotiation between the parties for a period of at least thirty (30) days. If unresolved, the dispute shall be referred to binding arbitration administered under the Malta Arbitration Act, with the seat of arbitration in Valletta, Malta, and the proceedings conducted in English. Notwithstanding the foregoing, either party may bring an action for injunctive relief in the courts of Malta, which shall have exclusive jurisdiction over such proceedings.

    If you are a consumer, nothing in this section removes the mandatory consumer-protection rights of the country in which you reside: you keep the right to bring or defend proceedings before the courts of your home country, and the arbitration clause above does not apply to you to the extent it is unenforceable against consumers. You can always raise a complaint with us directly at support@trepeat.com or with the consumer-protection authority in the country where you live.

    15. Indemnification

    To the maximum extent permitted by law, you agree to indemnify and hold harmless Trepeat and its operator from and against any claims, liabilities, damages, losses, and reasonable expenses (including legal fees) arising out of or connected with your use of the Service, your trading activity, your breach of these Terms or the Acceptable Use Policy, or your violation of any law or third-party right (including any broker or prop-firm agreement). This clause does not apply to the extent a claim arises from our own wilful misconduct or gross negligence, and it does not limit any non-waivable rights you have as a consumer.

    16. Miscellaneous

    • Severability. If any provision of these Terms is held invalid or unenforceable, the remaining provisions continue in full force and effect.
    • Entire agreement. These Terms, together with the Privacy Policy, Refund Policy, Acceptable Use Policy, and Risk Disclosure, constitute the entire agreement between you and us regarding the Service and supersede any prior agreement on that subject.
    • Assignment. You may not assign or transfer these Terms without our prior written consent. We may assign these Terms in connection with a merger, acquisition, or sale of assets, on notice to you.
    • No waiver. Our failure to enforce any right or provision is not a waiver of that right or provision.
    • Force majeure. We are not liable for any failure or delay in performance caused by events beyond our reasonable control, including third-party infrastructure or broker outages, acts of God, or governmental action.
